A counterfeit Rolex is a trademark violation, not a copy

A counterfeit watch uses another company's trademark without permission. On a Rolex counterfeit, that means the Rolex name, the five-point coronet, or a model name such as Submariner, Datejust, or GMT-Master. A watch with similar styling that carries its own brand name is a homage. Homages are legal to buy and sell. The legal line is the mark, not the case shape.

Importing, selling, or trafficking in counterfeit goods is a federal crime under 18 U.S.C. 2320. A first conviction carries up to 10 years in prison. Civil suits under the Lanham Act allow statutory damages up to $2,000,000 per counterfeit mark when the use is willful.

Most production sits in Guangdong province, China. Assembly shops cluster in Guangzhou, Shenzhen, and Dongguan. Sellers sort output into batches and label them with factory nicknames such as Noob, VSF, Clean, ZF, and ARF. Parts come from separate suppliers.

How to tell a counterfeit from a genuine Rolex

  • Balance wheel: genuine Rolex calibers use a free-sprung balance with Microstella regulating nuts. Most clones use a regulator arm and a stud carrier.
  • Weight: a solid 18k gold Rolex weighs more than a steel case with gold plating.
  • Date magnifier: Rolex uses 2.5x magnification on the cyclops. Many counterfeits sit near 2x or show distortion at the edge of the date.
  • Engravings: watches made after 2005 carry the serial on the rehaut at 6 o'clock and the model number between the lugs at 12 o'clock. Counterfeit stamping is shallow and off-center.
  • Service: Rolex service centers do not work on counterfeit watches and do not return counterfeit parts.

Scope of the counterfeit trade

The OECD put counterfeit and pirated trade at USD 464 billion in 2019, about 2.5 percent of world trade. Watches rank among the most copied categories. Enforcement removes shipments, but factories rebuild tooling and relabel batches under new nicknames.
